Terms of Service

Welcome to Upavāsa: Yoga Fasting Tracker (the "Application"), owned and operated by Kriyacode Technologies LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application, backend services, and APIs (collectively, the "Services").

Please read these Terms carefully before using the Services. By creating an account, subscribing to a plan, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Description of Services

Upavāsa is an intermittent-fasting tracking and guidance app that helps users:

  • Plan and track fasts across science-based protocols (16:8, 18:6, 20:4, OMAD, Extended, or custom).
  • Monitor fasting-stage progress (glycogen depletion, ketosis, autophagy) and fasting history/streaks.
  • Optionally receive Ayurvedic/yogic ("Ancient Wisdom") guidance alongside their fasting plan.
  • Sync fasting-relevant biomarkers with Apple Health / Health Connect.
  • Record voice check-ins, reviewed as transcribed text.
  • Optionally follow a generated, multi-week guided Challenge Plan (Pro tier).

The Services are provided for personal, non-commercial, educational, and wellness tracking purposes only.

2. Eligibility & Account Registration

  • Age: You must be at least 18 years of age to create an account and use the Services.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials, including any biometric login keys stored on your device. You agree to notify us immediately of any unauthorized access to your account.
  • Accuracy: You agree to provide accurate, complete, and up-to-date information during onboarding and profile configuration, particularly the health/contraindication information used to determine safe fasting recommendations.

3. Subscriptions, Billing, & Refunds

  • Fees: Access to Plus/Pro features (unlimited fasting, advanced analytics, autophagy/metabolic reports, the search & knowledge library, and Challenge Plans) requires a paid subscription. All fees are disclosed prior to purchase.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date through the respective app store (Apple App Store or Google Play Store).
  • Refunds: Transaction processing, billing, and refunds are handled directly through the Apple App Store or Google Play Store. All refunds are subject to their respective terms and conditions.

4. User Conduct & Content Restrictions

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Upload malicious code, reverse-engineer, or attempt to compromise the security of our APIs, servers, or client databases.
  • Submit voice check-ins containing defamatory, abusive, or illegal material.
  • Use the Platform to simulate or substitute professional medical treatment, diagnosis, or advice.

5. Intellectual Property

All content, design assets, algorithms, code, and branding (including "Upavāsa" and "Kriyacode Technologies LLC") are the exclusive property of Kriyacode Technologies LLC and are protected by international copyright, trademark, and intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on your mobile device for personal use only.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. See our Medical & Health Disclaimer for fasting-specific risk disclosures.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Kriyacode Technologies LLC, ITS AFFILIATES, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved exclusively through binding arbitration.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of these Terms and publishing the revision within the Application. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
